What are our rights regarding an inherited house?

Legal

Mehmet Aslan, founder of Aslan Tok Law Office and an attorney, provided information regarding inheritance rights.

He noted that inheritance is one of the most fundamental issues in Turkey, with inheritance-related cases appearing in courts across the country. He explained that while disputes often arise when assets are involved, the solutions are clearly outlined in the Turkish Civil Code.

Providing various examples, Aslan stated that if a deceased person leaves behind a spouse and children, one-fourth of the family home goes to the spouse, while the remainder is divided equally among the children. In cases where there is a surviving spouse but no children, half of the estate goes to the spouse, and the other half goes to the deceased’s parents.

He further mentioned that the process of transferring an inherited home has become easier; heirs can obtain a certificate of inheritance by visiting a notary public with their identification documents, and the subsequent transfer of the property title can be completed at the local land registry office.
